Terms and Condition

H&M Design Award 2019

These terms and conditions together with any specific instructions on the H&M Design Award’s official website (the “Website”) are the competition rules (the “Rules”) and apply to the H&M Design Award 2019 competition (the “Competition”).

The H&M Design Award 2019 is organized by H&M Hennes & Mauritz GBC AB, a company incorporated under the laws of Sweden whose registered office is at Mäster Samuelsgatan 46A, 106 38 Stockholm, Sweden, Reg. no 556070-1715 (“H&M”)

The Competition commences at February 20, 2018 and will end at December 31, 2018.

H&M may, at its sole discretion, apply, interpret, terminate, alter, limit, suspend or modify the Competition, and/or its rules, regulations or benefits at any time, without notice. Any changes will be posted either within these terms and conditions or on the H&M Design Award’s official website. The most recent terms and conditions will always be posted on the H&M Design Award’s official website. Any participant who refuses to accept the modifications to the terms and conditions must cease to take part in the Competition.

Qualifying entrants

The Competition is open to any natural person aged 18 or over who graduates from a 2018 BA or MA qualifying program from a design school participating in the Competition as posted on the H&M Design Award website (individually a “Candidate” and collectively the “Candidates”).

Employees, officers, directors, agents and representatives of H&M and the H&M Business Group or close relatives thereto (husband/wife, mother, father, brothers, sisters, sons, daughters or partners living in the same household) are not eligible to enter the Competition.

Residents in a country or jurisdiction where the competition may breach any law or regulation are not entitled to enter the competition. Where this applies, H&M invitation to enter the Competition in such country and/or jurisdiction is withdrawn.

H&M reserves the right to verify the eligibility of all Candidates and disqualify any Candidate if H&M has reasonable grounds to believe the Candidate has breach any of the Rules or acts in a way that could harm the name and reputation of H&M.

Under no circumstances shall the Candidates be considered as employees, agents or associates of H&M and participation in the Competition does not grant the Candidates the right to act in the name of or on behalf of H&M.

Competition entries

To participate in the Competition, Candidates must fill out the application on the Website. The application must be filled out in English.  In case of multiple applications by a Candidate, only the most recent submitted application will be taken into account by H&M.

The entries must consist of a collection based on garments, with at least four complete outfits. The collection cannot consist of only prints or accessories.  Entries containing fur, snake skin, trademarks, racial or offensive language are not acceptable.

The collection must be designed and manufactured in accordance with internationally agreed standards such as the Universal Declaration of Human Rights, The UN Convention on the Rights of the Child and applicable ILO Conventions, as well as national legislation.

Applications that are incomplete, submitted late or that contains false or misleading information will not be admitted in the Competition. H&M has no obligation to inform Candidates whose applications are inadmissible about this.

The Candidates who has been selected to advance to the semifinal are responsible for making sure that the entries are delivered on time to the location of the judging of the semifinal. If the entries are not delivered on time, H&M reserves the right to disqualify the entries.

To participate in the Competition, the Candidates must be fluent in written and spoken English.

Judging

The Competition is a game of skill and chance plays no part in the selection of the winners.

Entries will be judged on the designers’ creativity and innovation, the element of surprise and the craftsmanship as well as how well-made and well-coordinated the collection is.

The entries will be judged by a jury led by Ann-Sofie Johansson, Creative advisor at H&M  (the “Jury”). One winner will be chosen by the Jury (the “Winner”). In the event of any dispute regarding the Rules or the results and all other matters relating to the Competition, the decisions are final and no appeal shall be admitted nor shall any correspondence be entered into.

Prizes

The eight (8) finalists in the Competition shall receive a prize sum in the amount of five thousand (5000) euros.

The Winner shall receive a prize as follows:

  1. A prize sum in the amount of fifty thousand (50 000) euros
  2. Mentorship by H&M during one year when working together with H&M on the winning collection.
  3. The possibility to develop and sell selected pieces from the winning collection through selected H&M channels.

H&M and the Winner shall enter into an agreement to set forth the terms of the collaboration.

The prize is strictly personal and may not be transferred to, assign to or used by a third party.

Prizes are awarded at H&M’s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any Candidate. Where entries are being judged on creative or artistic merit or other subjective criteria, H&M reserves the right not to select a winner, and or to remove or amend selection criteria and or the structure and operation of the Competition if entries are not of the requisite standard.

H&M reserves the right to inform the Winner personally and the Winner and the Candidates undertake to keep this information confidential until the official public announcement by H&M.

Intellectual Property Rights and Use of Entries

For the purpose of judging the Competition, Candidates grant to H&M a perpetual, irrevocable, non-exclusive, transferable, sub-licensable, royalty-free worldwide license to any content covered by intellectual property rights, including but not limited to documents, patterns, sketches, artworks, photographs, likeness, illustrations, films, edits and audio recordings submitted to the Competition.  Under this license, H&M is authorized to use all or part of the content, by any means and as often as H&M deems necessary within the scope of the Competition.

The Candidates guarantee that they hold all intellectual property rights to the content in the entries and have the right to grant the above mentioned license to H&M.

The Candidates guarantee that the content in the entries does not infringe any third party rights and that it is not  subject to any third party claims or actions of infringement or invalidity.  H&M reserves the right to remove any entries based on suspicion of copyright infringement.

Photographs and films shot by H&M including but not limited to the Candidates and their collections shall be the property of H&M.  H&M shall have the right to alter the photographs and films at its sole discretion.  H&M shall have the right to use full names and likeness of the Candidates. H&M shall have the right to publicize the photographs and films in all media without prior approval by the Candidates.

By entering the Competition and accepting the Rules, the Candidates agree that H&M may use its personal details for the purpose of conducting the Competition.

Limitation of Liability

H&M will not be liable for any loss or damages arising from entering the Competition or in any other way relating to the Competition, except for any liability which cannot be excluded by law.

H&M cannot be held responsible for any cost associated  with winning the prize, else than what is specified in the Rules. If costs such as taxes or loss of income would arise as a result of winning the Competition, they shall be covered by the Winner.

Governing law and Dispute Resolution

The Competition and the Rules will be governed by Swedish law and any disputes will be subject to the exclusive courts of Sweden.  Candidates accessing the Competition outside of Sweden will be responsible for compliance with all local laws.
